PNW Software Solutions provides automated SMS messaging through Waveline, delivering account updates, service notifications, and promotional content to users.
Cancellation Policy
Users may exit the SMS program anytime by texting STOP to the designated short code. Confirmation of unsubscription follows via text message. Rejoining requires standard signup procedures.

Carrier Liability
Carriers are not liable for delayed or undelivered messages.
Message & Data Rates
Standard message and data charges may apply based on your wireless carrier’s plan. Message frequency varies with account activity and user preferences. Contact your wireless provider regarding plan specifics.
Privacy Policy
Privacy inquiries should reference the company’s Privacy Policy.
Business Verification
PNW Software Solutions may request verification documents including business registration papers, EIN letters, address proof, government IDs, opt-in documentation, and industry verification. Compliance is mandatory within 48 hours or service suspension may occur without refund.
Messaging Policy
All communications through Waveline qualify as Application-to-Person (A2P) messaging under carrier guidelines and Campaign Registry standards. Customers bear responsibility for all transmitted messages and authorized user activity.
A2P 10DLC Registration
Customers authorize PNW Software Solutions to submit A2P 10DLC registrations to approved carrier registration partners and campaign registries, providing necessary business information and acting on the customer’s behalf.
Consent / Opt-in Requirements
Prior message transmission requires:
- Explicit written or electronic consent from each recipient
- Clear disclosure of message types
- Specified message frequency
- “Message and data rates may apply” notice
- Transparent opt-out instructions
Consent records must include timestamp, consent method, IP address (for electronic consent), and consent language, retained for a minimum of five years. Consent applies only to registered use cases; different message types require fresh consent.
Message Content Requirements
Every message must:
- Clearly identify the sender (except in ongoing conversations)
- Match registered use cases and sample messages
- Include opt-out instructions (“Reply STOP to unsubscribe” or equivalent)
- Comply with TCPA and CAN-SPAM regulations
Opt-out Requirements
- All standard opt-out keywords (STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT) must be honored
- Opt-outs process immediately and automatically
- Single confirmation message only permitted post-opt-out
- Suppression lists of opted-out numbers must be maintained
- No subsequent messages after opt-out
Prohibited Content
Messages cannot contain:
- Illegal content or promotion of illegal activities
- Hate speech, harassment, or discriminatory material
- Adult or NSFW content
- Cannabis-related messaging
- Phishing, spam, or deceptive content
- Third-party intellectual property violations
- High-risk financial services (cryptocurrency, payday loans, collections)
Customer Attestations
Customers confirm:
- All provided business information is accurate and current
- Full organizational authority for registration
- Compliance with applicable messaging laws including TCPA
- Prompt notification of business information changes
- Understanding that false information may result in campaign rejection or suspension
Compliance Responsibilities
Customers are solely responsible for:
- Message content compliance with TCPA, CAN-SPAM, CTIA guidelines, and carrier policies
- Obtaining and documenting recipient consent
- Maintaining five-year opt-in records and honoring opt-outs
- Ensuring messages match approved use cases
- Responding to carrier or regulatory compliance inquiries
Monitoring and Enforcement
PNW Software Solutions may:
- Monitor message compliance
- Request opt-in record samples anytime
- Immediately suspend service for violations
- Report violations to carriers and The Campaign Registry
- Charge customers for fines or penalties from non-compliance
Cooperation with Investigations
Customer agrees to fully cooperate with any compliance investigations by providing documentation within 24 hours, granting message log access, participating in remediation, and implementing required changes. Non-cooperation triggers immediate service suspension.
Fees and Charges
- A2P 10DLC registration fees pass through without markup
- Monthly brand and campaign fees apply per TCR charges
- Secondary vetting and verification fees may apply
- All A2P 10DLC fees are non-refundable post-submission
- Prepayment may be required
Indemnification
Customers indemnify PNW Software Solutions from claims arising from inaccurate business information, non-compliant messaging, regulatory violations, unauthorized service use, third-party claims, message content issues, consent failures, or consumer complaints.
Right to Suspend Service
PNW Software Solutions may immediately suspend or terminate services without notice for:
- Detected compliance violations
- Registration partner, registry, or carrier flags for suspicious activity
- Inaccurate registration information
- Messaging practices risking company reputation or infrastructure
- Failed fee payments
- Failure to provide verification documents within specified timeframes
Data Processing and Privacy
PNW Software Solutions processes customer data solely for A2P 10DLC registration, sharing with authorized registration partners and campaign registries as necessary. Reasonable security measures protect customer data. Registration data persists per regulatory requirements post-termination.
Limitation of Liability
PNW Software Solutions’ total liability for any claims related to A2P 10DLC services shall not exceed the fees paid by Customer in the preceding 12 months. Indirect, consequential, or punitive damages are excluded.
Termination
Either party may terminate with 30 days written notice. Customers remain responsible for accrued fees and ongoing compliance obligations.
Governing Law
Terms are governed by Washington State law, excluding conflict of law principles.
Modifications
PNW Software Solutions reserves the right to modify these terms at any time. Continued use of services after modification constitutes acceptance.
